Administration

Context

You are the Administrator ("Admin Inc.") of a work. The Publisher ("The Pub Inc.") has granted you an administration mandate. This mandate can cover the entire world or be limited to one or several territories. You want to register the work with your Collective Management Organization (CMO) so that you can collect rights on behalf of the Publisher.

Here are the two most common approaches:

Case 1 β€” Worldwide Administration

You, the Administrator ("Admin Inc."), have a mandate for the entire world.

Key points

  • You collect rights worldwide on behalf of the Original Publisher.
  • The Original Publisher is still declared as the rights owner.
  • You are declared as the worldwide collecting entity.
  • This setup is used when you have a global mandate and ensures full CWR compliance.

Case 2 β€” Territorial Administration

You, the Administrator ("Admin Inc."), have a mandate for one or several territories (e.g. France, Germany, Benelux).

Key points

  • You collect rights only in the territories specified in your mandate.
  • The worldwide chain of rights remains identical to Publishing.
  • Two practices exist:
  • The Original Publisher files the registration and declares you as collector in those territories.
  • Or you file your own registration directly with the relevant societies.
  • This approach ensures precise compliance with CWR rules for territorial administration.
